Enduro Tours in Bulgaria

1. Tour and Rental Agreement:
This Agreement shall be effective upon written confirmation of participation from Sport Camps Bulgaria (thereafter referred to as “Organizer”) and is for both obligatory.

2. Breadth of Services:
2.1. The range of services scope of this Agreement shall be determined by the corresponding website in effect upon time of application. Any services not explicitly described in the website shall not be included within the Tour fee. 
2.2. Organizer has the right to change the Tour details and elements, if necessary for good cause or due to forcemsajor conditions. Organizer has to keep the main characteristics of the Tour and render equal services. 

3. Participants obligations & requirements:
3.1.  A valid driving license with proper motorcycle endorsement is absolutely required for all tours. Participants without such driving license will not be allowed to paricipate in the tours. 
3.2. Judging his or her personal capabilities, competense and riding level is exclusively participant’s responsibility. The participant him/herself has to estimate if he/she could manage the tour difficulty. The organizer and the tour guide are under no obligation to determine and verify the participant’s competence, capabilities and riding skills.
3.3. The organizer or the tour guide has the right to cancel the participation of a person in case his/her behaviour may couse injuries to him/herself or to other participants. 
3.4. The tour reservations are made according the chronological order of the aplications and payments. As the reservation is valid the participants will receive  all the necessary documents and additional information about the tour, as well as written confirmation of the reservation via e-mial or post services! The participant will receive a valid booking confirmation after an advanced down payment.
3.5. In the tours are allowed motorcycle models of all brands, in accordance to the defined safety requirements for each tour!
3.6. All Participants are obliged to ride with helmet and adequate protective equipment.
3.7. If Participant takes part in the tour with his/her own dirt bike, he/she is fully responsible for the perfect technical condition of the motorcycle and the compliance with all mandatory Organizer’s requirements (specified in the booking documents). Organizer and tour guide have no obligation to observe the compliance with these requirements.
3.8. In case the participant infringes the official Bulgarian traffic law or tour guide instructions the Organizer hsa the right to cancel the his/her participation in the tour and seize the motor bike. The tour and the deposit fees are not refundable in this case.

4. Motor bike rental conditions:
4.1. The Enduro bike rental is included in the price of each tour. With the booking the participant has a valid reservation for an enduro bike. The rental enduro bike could be only be used during the official tour program.
4.2.  If the participant has the will to take part in the tour with his/her own bike he has to check this option in the booking form. Choosing this option participant will be officialy informed about the new tour price. 
4.3. There is a possibility that the participant shall be asked to put down an additional security deposit fee. This fee, minus eventual expenses for repairs of damages to the motor bike, shall be reimbursed to the customer upon returning the rented motor bike. 

5. Liability: 
5.1. Participants take part in the tours at their own risk. The liability of Sport Camps Bulgaria and it’s respective staff and/or employees, is limited to the amount of the Tour fee, regarding participants’s loss arising from his participation in the tour, unless the damage is caused by Sport Camps Bulgaria or it’s respective sub-contractors and/or employees’ due to gross negligence.
5.2. Participant shall sign a separate declaration on limitation of liability before participating on the Tour. This declaration is submitted to the participant along with the booking confirmation. If the participant does not submit the signed declaration upon 14 days before the tour starting date, the Organizer has the right to terminate immediately this Agreement. The reimbursement of the paid amount will be made under the conditions of the Organizer’s cancellation policy.
5.3. Personal health insurance is absolutely mandatory. The Organizer is not liable in case of any injury covered or not by the insuarance policy.

6. Payment:
6.1. A down payment of 30% / person of the tour fee is required within 1 week upon reservation of the tour. With the payment the participant will receive a valid booking confirmation.
6.2. The rest of the amount shall be paid latest 2 weeks prior to the Tour. Any bank commissions will be supported by the Participant.

7. Cancellation policy:
7.1. The following cancellation fees shall become due upon cancellation by the applicant:
- 30 % of the Tour fee up to 2 weeks prior to the Tour;
- 100 % of the Tour fee within 2 weeks prior to the Tour or non-attendance without notification.

8. Cancellation of the Tour:
8.1. The Organizer has the right to postpone or cancel the Tour anytime for good cause or due to forcemajor conditions. The Organizer may also cancel the Tour up to one week prior to the starting date, in case that too few participants have valid bookings for the Tour. The Participant shall be informed thereof in writing without delay.
8.2. In case of Organizer postponing or canceling the Tour, Participant may choose to either participate in a similar Tour, if feasible for Promoter, or to be reimbursed.

9. Governing Law and Venue:
This Agreement shall be governed by the laws of Bulgaria, unless restricted by law. Litigation arising out of this Agreement shall be held at the court of Sofia, Bulgaria.
